Agreement to Our Legal Terms

We are A-World Int'l, Inc., a California corporation doing business as AWII SPORT ("Company," "we," "us," "our"), located at 3333 S Brea Canyon Rd, Ste 211, Diamond Bar, CA 91765, United States.

We operate the website awiisports.com (the "Site") and any related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms are a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and A-World Int'l, Inc., concerning your access to and use of the Services. By accessing the Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU MUST NOT USE THE SERVICES.

Supplemental policies posted on the Services, including our Shipping Policy, Return & Refund Policy, and Privacy Policy, are incorporated into these Legal Terms by reference. We may change these Legal Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Services after changes are posted means you accept the revised Legal Terms.

The Services are intended for users who are at least 18 years old.

Our Services

We sell products to customers in the United States only, and we ship only to the destinations listed in our Shipping Policy. Persons who access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

Intellectual Property Rights

We own or license all intellectual property rights in the Services, including website designs, text, photographs, graphics, video, and software (the "Content"), as well as the trademarks, service marks, and logos contained in them (the "Marks"). User Representations

By using the Services, you represent and warrant that: (a) all information you submit, including account, billing, and shipping information, is true, accurate, current, and complete, and you will keep it updated; (b) you have the legal capacity to agree to these Legal Terms; (c) you will not access the Services through automated or non-human means; and (d) you will not use the Services for any illegal or unauthorized purpose.

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. If any information you provide is untrue, inaccurate, or incomplete, we may suspend or close your account and refuse current or future use of the Services.

Products

We make every effort to display product colors, features, specifications, and details as accurately as possible. However, we do not guarantee that this information is complete, current, or free of errors, and your screen may not accurately reflect actual colors and details. All products are subject to availability. We may discontinue any product at any time, and prices are subject to change.

Basketball hoops must be assembled, filled, and used according to the installation manual for your model. Please read the manual before assembly and use.

Purchases and Payment

We accept payment through Shopify Payments, including major credit cards and Shop Pay. All payments are in US dollars.

You agree to provide current, complete, and accurate purchase information, and you authorize us to charge your chosen payment method for the total amount of your order, including applicable shipping fees and sales tax, when you place your order. We may correct any pricing errors, even after we have requested or received payment.

We may refuse or cancel any order, and we may limit quantities purchased per person, per household, or per order, including orders placed under the same account, payment method, or billing or shipping address. We may limit or refuse orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.

Shipping, Returns, and Warranty

Shipping destinations, rates, and delivery times are described in our Shipping Policy. Returns, refunds, replacement parts, and our 2-year warranty are described in our Return & Refund Policy. Please review both before making a purchase.

Prohibited Activities

You may not use the Services for any purpose other than that for which we make them available. You agree not to:

  • Systematically retrieve data or content from the Services to build a collection or database without our written permission.
  • Trick, defraud, or mislead us or other users, or attempt to obtain sensitive account information.
  • Circumvent, disable, or interfere with security-related features of the Services.
  • Upload or transmit viruses or other material that interferes with the Services, or place an undue burden on the Services or connected networks.
  • Use any bot, scraper, data-mining tool, or other automated system to access the Services, except through standard search engine or browser use.

If we offer areas on the Services to leave reviews or other content, anything you post must be based on your own experience, must be truthful, and must not be offensive, discriminatory, defamatory, infringing, or unlawful. We may accept, reject, or remove reviews at our discretion, and reviews do not represent our views. Modifications and Interruptions

We may change, modify, or remove the contents of the Services at any time without notice, and we may modify or discontinue all or part of the Services without notice. We cannot guarantee that the Services will always be available; hardware, software, or maintenance issues may cause interruptions, delays, or errors. We are not liable for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime.

Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Dispute Resolution

Any legal action brought by you or us (each a "Party") shall be commenced in the state and federal courts located in the State of California, and the Parties consent to the personal jurisdiction and venue of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Legal Terms.

Information on the Services may contain typographical errors, inaccuracies, or omissions, including in descriptions, pricing, and availability. We may correct any errors and update information at any time without prior notice.

EXCEPT FOR THE EXPRESS WARRANTY DESCRIBED IN OUR RETURN & REFUND POLICY, THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS, AND YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

Miscellaneous

We are not responsible for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
